Refund and Cancellation Policy

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name fadfocus.in ("Website"), including the related mobile site and mobile application (hereinafter referred to as "Platform").

The Platform is owned by FadFocus, a company incorporated under the Companies Act, 2013 with its registered office at Pune (hereinafter referred to as "Platform Owner", "we", "us", "our").

This refund and cancellation policy outlines how you can cancel or seek a refund for a product / service that you have purchased through the Platform. By purchasing products or services on the Platform, you agree to be bound by this Policy. This Policy can be modified at any time without assigning any reason. It is your responsibility to periodically review this Policy to stay informed of updates.

1. Order Cancellation

Cancellations will only be considered if the request is made within 2 days of placing the order. However, cancellation requests may not be entertained if the orders have been communicated to such sellers / merchant(s) listed on the Platform and they have initiated the process of shipping them, or the product is out for delivery. In such an event, you may choose to reject the product at the doorstep. Platform Owner reserves the right to accept or reject cancellation requests at its sole discretion.

2. Perishable Items

FADFOCUS does not accept cancellation requests for perishable items like flowers, eatables, etc. However, the refund / replacement can be made if the user establishes that the quality of the product delivered is not good. The quality assessment shall be at the sole discretion of Platform Owner or the seller/merchant.

3. Damaged or Defective Items

In case of receipt of damaged or defective items, please report to our customer service team. The request would be entertained once the seller/ merchant listed on the Platform, has checked and determined the same at its own end. This should be reported within 2 days of receipt of products. You may be required to provide photographs or other evidence of the damage or defect. Platform Owner reserves the right to verify the claim before processing any refund or replacement.

4. Product Not as Described

In case you feel that the product received is not as shown on the site or as per your expectations, you must bring it to the notice of our customer service within 2 days of receiving the product. The customer service team after looking into your complaint will take an appropriate decision. Platform Owner's decision in this regard shall be final and binding.

5. Warranty Products

In case of complaints regarding the products that come with a warranty from the manufacturers, please refer the issue to them. Platform Owner shall not be liable for any warranty claims, and such claims shall be handled directly between you and the manufacturer in accordance with the manufacturer's warranty terms and conditions.

6. Refund Processing

In case of any refunds approved by FADFOCUS, it will take 2 days for the refund to be processed to you. Refunds will be processed to the original payment method used for the purchase. The actual credit to your account may take additional time depending on your bank or payment gateway's processing time. Platform Owner shall not be liable for any delays in refund processing by payment gateways or financial institutions.

7. Refund Amount

The refund amount will be calculated based on the product price paid by you, excluding any shipping charges, handling fees, or other charges that may be non-refundable as per Platform Owner's policy. Platform Owner reserves the right to deduct any applicable charges or fees from the refund amount.

8. Limitation of Liability

In no event will the Platform Owner be liable for any indirect, consequential, incidental, special or punitive damages, including without limitation damages for loss of profits or revenues, business interruption, loss of business opportunities, loss of data or loss of other economic interests, whether in contract, negligence, tort or otherwise, arising from the use of or inability to use the Services, however caused and whether arising in contract, tort, negligence, warranty or otherwise, exceed the amount paid by You for using the Services giving rise to the cause of action or Rupees One Hundred (Rs. 100) whichever is less.

9. Force Majeure

Notwithstanding anything contained in this Policy, the parties shall not be liable for any failure to perform an obligation under this Policy if performance is prevented or delayed by a force majeure event, including but not limited to natural disasters, acts of God, war, terrorism, labor strikes, government actions, or other events beyond the reasonable control of the parties.

10. Governing Law and Jurisdiction

This Policy and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India. All disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.
